    Tokens

    Refers to the invented digital currency used to trade items on the Site. For indicative purposes only in exchange for the retail value of an item listed on the Site. Tokens cannot be exchanged for money.

  3. Description of the Site

    Our Site offers users an online marketplace platform which allows users to trade (by offering for sale or purchasing) fashion items solely in exchange for Tokens.

    When you offer your items for sale to other users, the item will be designated a token value based on the item loading criteria and retail price. Other users may either purchase your item for the designated token value or offer a different token value for the item.

    Each user earns Tokens through the sale of his/her own items or gain them from as us an award for loading an item onto the Site.

  4. Using the Site

    The Site is for your personal and non-exclusive use only. As long as you comply with these Terms of use Tambourine Group Limited grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

    You may not use any “page scraper”, “robot”, “spider”, “deep link” or other automatic device, programme, algorithm or methodology, or any similar or equivalent manual process, to access, copy, acquire or monitor any part of the Site, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site.

    You may not attempt to gain unauthorised access to any part or feature of the Site, or any other systems or networks connecting to the Site or to any of our servers, or to any of the services offered on or through the Site by password “mining”, hacking or any other illegitimate means.

    You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to us on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

    You may not use this Site or any Content for any purpose that is unlawful or prohibited by these Terms of use, or to solicit the performance of any illegal activity or other activity which infringes our rights or those of other users.

    You hereby warrant that each item offered by you for sale through the Site is owned by you, or that you are otherwise permitted to sell it to other users through the Site. In addition, you hereby warrant that any item offered by you forsale through the Site does not infringe third party rights including without limitation intellectual property rights, consumer rights etc).

    We may prevent or suspend your access to the Site if you do not comply with any part of these Terms, any Terms or policies to which they refer or any applicable law.

  5. Payment and Tokens

    The Site operates using a token currency you cannot make payments for items on the Site using currency other than Tokens. However, payment information may be obtained to process subscription fee and shipping requests made through the Site. We use a third party to process these payments which directly obtains and handles your credit/debit card and other payment information.

    As Tokens are a digital currency that can only be used within the Site, they are not a legal tender, debt or obligation and cannot be bought or sold for money.

    If an item is found to have been misdescribed when sold, any cost of returning these items will be at your expense. We have the authority to cancel Tokens for any reason effective upon sending notice to you at the email address you provide whilst registering or such other email address as you may later provide. If an item has been missed sold, the buyer will be reimbursed with the equivalent Tokens.

  6. Ownership, use and intellectual property rights

    This Site and all intellectual property rights in it, including but not limited to any Content, are owned by us, our licences or both (as applicable). We under licensers reserve all of our and their rights in any intellectual property in connection with these Terms. This means, for example, that we and they remain owners of them and free to use them as we and they see fit.

    Nothing in these Terms grant you any legal rights in the Site other than as necessary to enable you to lawfully access the Site as intended and authorised by us. By uploading Content to any public area of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to us an irrevocable, perpetual, non-exclusive, fully paid, worldwide licence to use, copy, perform, display, and distribute such information and Content and to prepare derivative works of, or incorporate into other works, such information and Content, and to grant and authorise sublicenses of the foregoing.

  7. Submitting information to the Site

    While we try to make sure that the Site is secure, we cannot guarantee the security of any information that you supply to us. We therefore cannot guaranteethat it will be kept confidential. For that reason, you should not submit any patentable ideas or patent applications, advertising or marketing suggestions, prototypes or any other information that you regard as confidential, commercially sensitive or valuable (unwanted submissions) to the Site.

    We may use any unwanted submissions as we see reasonably fit on a free of charge basis (bear in mind that we have no way of knowing whether such information is confidential, commercially sensitive or valuable because we do notmanage the Site to check for these matters). Therefore, we will not be legally responsible for keeping any unwanted submissions confidential nor will we be legally responsible to you or anybody else for any use of such unwanted submissions.

    Because we do not control user Content, you acknowledge and agree that we arenot responsible for any user Content and we make no guarantees regarding the accuracy, suitability, or quality of any user Content. your interactions with other users on the Site are solely between you and such user. You agree that we will not be responsible for any loss or damage incurred as a result of any such interactions. We shall not be responsible or liable, directly or indirectly, for any damage or loss, cost or expense incurred by you or any other person as a result of or in connection with the exchange of items with other users. We take no part in the delivery of purchased items to users and we do not guarantee the delivery of items from one user to another. It is the sole responsibility of the user selling the item to ensure delivery of the item to the other user.

  10. Rights of third parties

    No one other than a party to these Terms has any right to enforce any of these Terms.

  11. Disputes

    We will try to resolve any disputes with you quickly and efficiently.

    If you are unhappy with those please contact us as soon as possible.

    If you and we cannot resolve the dispute using our complaint handling procedure, we will:

      Let you know that we cannot settle the dispute with you; andgive you a certain legally required information about our alternative dispute resolution provider which is run by the Chartered Institute of arbitrators at 12 Bloomsbury square, London, WC1A 2LP, UK.

    If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms.

    Relevant United Kingdom law will apply to these Terms.
